Joshua Kahane, a former Assistant United States Attorney for the Southern District of New York, represents corporations and individuals in complex civil litigation in both state and federal court, as well as in government investigations.

Prior to joining Schlam Stone & Dolan, Joshua was a senior associate with Paul Hastings LLP where his practice focused on commercial and white collar litigation as well as internal and government investigations, with an emphasis on the life sciences and financial services industries. Prior to Paul Hastings, Joshua served as an Assistant United States Attorney for the Southern District of New York, Civil Division, where he investigated allegations of fraud against the United States under the False Claims Act, Anti-Kick Statute, and other statutes. He also represented federal agencies and officers in a wide variety of affirmative and defensive matters, including cases involving bankruptcy and tax, immigration, constitutional law, and torts.  Prior to his government service, Joshua worked as an associate at Weil, Gotshal & Manges LLP where his practice focused on complex commercial and intellectual property (copyright and trademarks) litigation.

Joshua graduated magna cum laude from the University of Pennsylvania Law School, where he was Senior Editor of the University of Pennsylvania Journal of Constitutional Law, and earned a Wharton Certificate in Management. He graduated summa cum laude from Brandeis University.

  • Represented a global rare disease pharmaceutical manufacturer in connection with a Department of Justice investigation involving allegations of off-label marketing. The DOJ terminated its investigation without taking any enforcement action;

  • Represented an energy company in a contested reorganization bankruptcy trial;

  • Represented a financial lender in connection with a state attorney general investigation;

Government Sector

  • Conducted affirmative civil healthcare fraud cases involving the False Claims Act, speaker programs, specialty pharmacies, and genetic testing;
  • Managed a docket of over 70 active affirmative and defensive matters on behalf of the United States of America’s Executive Branch agencies, including civil rights, employment, immigration, constitutional, tort, tax, and bankruptcy matters;
  • Investigated civil rights violations under the Americans with Disabilities Act and Title VII.
