In Bennett Sprecher and Promenade Theatre Corp. v. William P. Miller, et al., Index No. 655888/2020 (N.Y. Supreme Court, N.Y. County), Justice Lyle Frank issued a Decision and Order on December 9, 2024 granting Plaintiffs’ motion for sanctions. The dispute, which recently generated another SSD victory, involves tort and contract claims surrounding a company formed to manage the Promenade Theatre, on Manhattan's Upper West Side.

In the December 9, 2024 decision, the Court ordered that Defendants’ answer would be stricken if certain documents were not produced within seven days following service of the order. The Court also ordered control over the corporation’s books and records to be turned over to Plaintiffs. Last, the Court ordered Defendants to pay SSD’s reasonable fees and costs of making their sanctions motion, along with fees incurred in connection with a prior sanctions motion the Court had previously granted in part.
