In Bennett Sprecher and Promenade Theatre Corp. v. William P. Miller, et al., Index No. 655888/2020 (N.Y. Supreme Court, N.Y. County), Justice Lyle Frank issued a Decision and Order on October 23, 2024, handing SSD's clients a significant victory in the case. The dispute involves tort and contract claims surrounding a company formed to manage the Promenade Theatre, on Manhattan's Upper West Side.
The Court first denied defendants' motion for summary judgment, finding that factual issues prevented such an award and deeming the summary judgment motion substantially similar to the motion to dismiss the defendants previously filed.
Next, SSD's arguments in a motion for re-argument persuaded the Court to reverse itself and reinstate breach of contract claims it had previously dismissed.
Finally, the Court granted SSD's motions for sanctions in part, by forcing the defendants to turn over additional documents or provide an affirmation explaining why they could not.
