Unenforceable Provision, Fabrication Claims, Counsel Conflict
This column reports on several signigicant representative decisions handed down recently in the U.S. District Court for the Eastern District of New York. Judge Brian M. Cogan held that a confidentiality provision in a settlement was unenforceable under the circumstances. Judge I. Leo Glasser restored claims of fabricated evidence against the estate of deceased former District Attorney Hynes and others after a controlling Second Circuit decision was reversed by the Supreme Court. And in a §1983 case Magistrate Judge James M. Wicks disqualified defense counsel for a conflict of interest.
